Warranty Information
Stellar Security (referred to as “Stellar”) provides a warranty under the following terms and conditions. If our product becomes defective due to improper workmanship or material defects during the specified warranty period, Stellar will repair or replace the unit at no additional cost.
- Labor Coverage: Covers labor for 1 year from the original installation date.
- Product Coverage: Cameras, recorders, and hardware are warranted against defects by the manufacturer for up to 2 years, with some items covered for up to 3 years.
- Labor/Installation Coverage: Camera system labor/installation is covered for 2 years, with certain packages extending to 3 years.
- Exclusions: The warranty does not cover damage from misuse, abuse, negligence, fire, or acts of God.
- Transferability: The warranty can transfer to new business operators or homeowners.
Terms and Conditions
1. General Agreement
This agreement constitutes a legal contract between Stellar and customers purchasing our goods and services. By signing, you agree to these terms and conditions:
- Premises: Refers to the address where we supply goods and services.
- You: Refers to the owner/operator of the premises.
- We, Our, Us: Refers to Stellar.
- Goods and Services: Refers to the products and services described in this document.
2. Commitment of Owners/Operators
You and any other owners/operators of the premises are bound by this agreement. You must obtain the necessary consent to enter into this agreement on behalf of all owners/operators.
3. Third-Party Providers
Your camera system relies on third-party communication facilities. We do not control or maintain these facilities and assume no responsibility for their repair. Any service calls due to failures in these facilities will incur additional charges. We do not assume liability for any loss, damage, or personal injury related to these facilities.
4. Limitations of Liability
Stellar is not an insurer, and our service is not a substitute for proper insurance. Determining damages from our failure to perform is difficult. Therefore, Stellar, including our agents, employees, and subcontractors, is not liable for any loss, damage, or injury resulting from our service or equipment, even if caused by negligence or failure to perform.
5. Payment Terms
You must pay all amounts due promptly, including any balance on installation. Do not withhold or set off any amounts against balances due. We reserve the right to remove equipment if full payment is not made or if equipment we own is installed on your premises.
6. Overdue Amounts
Interest will accrue on overdue amounts at a rate of 15% per annum and will be payable on demand.
7. Assignment
We may assign your account to another party upon written notice. You may assign your obligations and rights only with our written consent. There will be no subrogation of rights or obligations.
8. Ownership of Goods
Ownership of goods remains with us until we receive full payment, even if the goods are attached to the premises. Upon full payment, this Agreement will end, subject to applicable warranties.
9. Camera Positioning
Camera positioning and field of view are approximate and subject to confirmation by our professional installer. Actual field of view may vary based on site conditions and installation methods. We may adjust camera placement at our discretion.
10. Access to Premises
You must provide reasonable access to the premises for installation, inspection, repair, removal, or replacement of goods.
11. Projected Installation Date
The projected installation date is approximate and may vary due to scheduling, labor availability, and weather conditions. We are not liable for delays caused by Acts of God, public enemies, storms, fires, strikes, labor shortages, or other causes beyond our control.
12. Costs Related to Default
You are responsible for all costs incurred by us due to your default under this Agreement.
13. Indemnification
You agree to indemnify and hold us harmless from any damages, injuries, or claims related directly or indirectly to the installation of the goods.
14. Amendment
This Agreement may only be amended in writing with approval from both parties. Oral representations or warranties by the supplier or its agents do not alter this Agreement.
15. Severability
If any provision of this Agreement is unenforceable or invalid, it will not affect the validity of the remaining provisions. We will adjust the unenforceable provision to meet its original objectives within legal limits.
16. Privacy Policy
The Canadian Privacy Act governs the information you provide. Refer to our Privacy Policy on our website, www.stellarsecurity.ca, or request a copy by emailing us.
